Foreign nationals with exceptional abilities in the sciences, arts or business or individuals with an advanced degree can qualify for National Interest visas and waivers. The waivers for labor certification are granted if the presence of the foreign national in the country will be in the national interest of the United States.

A labor certification and at least 3 of the following:
* An official academic record showing that the alien has a degree, diploma, certificate, or similar award from an institution of learning relating to the area of exceptional ability;
* Letters from current or former employers showing that the alien has at least two years of full-time experience in the occupation for which he/she is being sought;
* A license to practice the profession or certification for a particular profession or occupation;
* Evidence that the alien has commanded a salary, or other remuneration for services, which demonstrates exceptional ability;
* Evidence of membership in professional association; or
* Evidence of recognition by peers, governmental entities, or professional organizations for achievement and significant contributions to the industry or field.
* If the above standards do not readily apply to the alien's occupation, you may submit comparable evidence to establish the alien's eligibility.
Processing Time:
5 - 12 months if National Interest is approved. 12 - 24 months if National Interest is not approved.
Note: Accompanying spouse and children under 21-years old can come along.
